Requirements
Eligibility for this permit is strictly defined by the Polish Act on Foreigners. You must fall into one of the following categories to qualify:
- Polish Origin: You must prove that at least one parent or grandparent, or two great-grandparents, were of Polish nationality. You must also demonstrate an intention to settle in Poland permanently.
- Karta Polaka Holders: If you hold a valid Karta Polaka and intend to settle in Poland, you are eligible for this permit immediately upon arrival.
- Spouses of Polish Citizens: You must have been married to a Polish citizen for at least 3 years before applying. Additionally, you must have resided in Poland continuously for at least 2 years on a temporary residence permit immediately preceding your application.
- Children: Minor children of a foreigner who already holds a Permanent Residence or EU Long-Term permit, or children of a Polish citizen under their parental custody, are eligible.
- Humanitarian Grounds: This applies to individuals who have lived in Poland for specific periods (usually 5 years) under refugee status, subsidiary protection, or for humanitarian reasons.
- Asylum: Individuals who have been officially granted asylum in the Republic of Poland.
Key Threshold: Uninterrupted Stay For categories requiring prior residence, your stay must be "uninterrupted." This means no single absence from Poland exceeded 6 months, and your total time outside of Poland did not exceed 10 months during the qualifying period.
Conditions & Warnings
As of January 2026, all applications must be submitted digitally via the MOS portal; paper submissions are no longer accepted.
Significant administrative backlogs exist in major cities like Warsaw and Wrocław, with actual processing often exceeding 12 months.
Applicants must notify the Voivode of any address changes to avoid 'delivery by fiction,' where legal notices are considered served even if not received.
Qualifications
No formal certificate required for the permit itself, though an interview in Polish may occur for those applying based on Polish origin.
Fees
640 PLN stamp duty + 100 PLN card issuance fee. Karta Polaka holders are exempt from the 640 PLN stamp duty.
