Requirements
To qualify for a Frontier Worker Permit, you must meet three primary criteria regarding your nationality, your residence, and the history of your work in the UK.
1. Nationality
You must be a citizen of an EU country, Switzerland, Norway, Iceland, or Liechtenstein.
- Irish Citizens: You do not need a permit to work in the UK due to Common Travel Area rights, but you may apply for one if you want a formal document to prove your status to employers or border officials.
2. The "Primarily Resident" Test
You must live "primarily" outside of the UK. The Home Office assesses this using specific time thresholds:
- The 180-Day Rule: You generally qualify if you spent fewer than 180 days total in the UK during any rolling 12-month period.
- The Return Exception: If you spent 180 days or more in the UK within a 12-month period, you can still qualify if you returned to your country of residence at least once every 6 months or twice in that 12-month period.
- Exceptions: Absences from your home country due to illness, accidents, or COVID-19 travel restrictions may be disregarded.
3. Work Requirements
You must prove that your work in the UK is "genuine and effective."
- The 2020 Deadline: You must have started working in the UK (as an employee or self-employed person) by December 31, 2020.
- Continuity: You must have worked in the UK at least once every 12 months since you started, unless you had a valid reason for a break (see "Retained Status" below).
- Threshold: The work cannot be "marginal or ancillary." For example, traveling to the UK just to sign a single contract or attend one interview does not qualify you as a frontier worker.
Retained Status
You can keep your status even if you stop working temporarily for specific reasons, including:
- Illness or accident.
- Pregnancy or childbirth.
- Involuntary unemployment (provided you are actively seeking work in the UK).
- Vocational training.
Conditions & Warnings
This permit does not lead to Indefinite Leave to Remain (ILR) or British citizenship as holders are not considered UK residents.
Applicants must have started frontier working in the UK by December 31, 2020, and maintained that status since.
A gap of more than 12 months in UK work evidence is a common reason for application refusal.
