Benin citizenship-by-marriage is a legal pathway that allows the foreign spouse of a Beninese national to acquire Nationalité Béninoise (Beninese nationality). Historically, Beninese law treated men and women differently in matters of citizenship. However, following the landmark passage of Law No. 2022-32 of December 20, 2022, the system was fully equalized. Today, whether you are a foreign man married to a Beninese woman or a foreign woman married to a Beninese man, you follow the exact same legal process and meet the same requirements. This pathway is an "acquisition by declaration," meaning that if you meet all legal criteria, you have a right to the nationality rather than it being a purely discretionary gift from the state.
Legal Framework and Recent Changes
The primary governing legislation is Law No. 2022-32 of December 20, 2022 (Loi portant Code de la nationalité béninoise). This law was a major reform that abolished the 1965 Code's discriminatory provisions. Under the old rules, foreign women married to Beninese men could acquire citizenship much faster, while foreign men married to Beninese women faced significant hurdles. The 2022 law standardized the five-year waiting period for everyone.
Additionally, while the marriage pathway is distinct, Benin has recently signaled a more open approach to nationality. In 2024, the government introduced Law No. 2024-31, allowing people of African descent to acquire nationality by recognition. While this does not change the marriage requirements, it underscores a modernizing trend in Beninese immigration law.
Rights as a Beninese Citizen
Once your application is approved and you receive your certificate of nationality, you hold the same legal standing as a natural-born citizen.

- Passport and Travel: You are eligible for a Beninese passport, which allows for visa-free travel within the ECOWAS (CEDEAO) bloc of West African nations.
- Work Rights: You have the unrestricted right to work in any sector, including the civil service and regulated professions that may be restricted to citizens.
- Dual Nationality: Benin generally permits dual nationality. You are not required by Beninese law to renounce your original citizenship, though you should check if your country of origin has different rules.
