Application Process
To apply for Beninese citizenship by marriage, you must follow a formal administrative process through the Ministry of Justice. Under the current Law No. 2022-32, this pathway is open to both foreign men and women on equal terms once you have reached five years of legal marriage.
Step 1: Document Preparation and Transcription
Before you can submit your file, you must ensure your marriage is legally recognized in Benin.
- If you were married outside of Benin, you must first obtain a transcription (official recording) of your marriage certificate into the Beninese civil status registers. This can be done at a Beninese consulate or the civil status office in Cotonou.
- Gather your Casier Judiciaire (police clearance) from both your home country and Benin.
- Ensure all foreign documents are translated into French and have an Apostille or legal stamp from the Beninese consulate in your country of origin.
Step 2: Submission
You must personally submit your application file to the Ministry of Justice and Legislation (Ministère de la Justice et de la Législation) located in Cotonou. Your file must include a formal request addressed to the Minister of Justice, your certified marriage certificate, proof of your spouse’s Beninese nationality (such as a Certificat de Nationalité), and your residency permit (Carte de Séjour).
Step 3: The Inquiry
After submission, Beninese authorities (typically the police or security services) will conduct an investigation. They will verify your "community of life" (communauté de vie), which means confirming that you and your spouse are actually living together as a married couple. They will also review your personal character and criminal history.
Step 4: Review and Decision
The Ministry reviews the legal validity of your marriage and confirms you have met the five-year duration requirement. Unlike standard naturalization, which is at the government's discretion, citizenship by marriage is treated as an "acquisition by declaration." If you meet all legal criteria, the government generally must grant the request.
Step 5: Registration
Once approved, you will be notified to complete the process. This may involve a formal registration of the acquisition with the court or taking an oath. After this, you can apply for your Certificat de Nationalité and a Beninese passport.

Processing Time
The timeline for citizenship is divided into a mandatory waiting period and the administrative processing phase.

- Administrative Processing: Once your file is submitted, it typically takes 6 to 18 months to receive a final decision.
- Document Validity: Most police clearances (Casier Judiciaire) are only considered valid for 3 to 6 months from the date of issuance; ensure yours are recent when you submit your final file.
Delays are common during the inquiry stage, as authorities must verify the authenticity of the marriage and conduct background checks. To avoid extra delays, ensure your marriage is transcribed immediately after your wedding if you married abroad.
