Overview
Slovak Citizenship by Descent (CBD) is a legal pathway that allows individuals with Slovak roots to reclaim the citizenship of their ancestors. Following a landmark amendment to Act No. 40/1993 Coll. on Citizenship that took effect on April 1, 2022, Slovakia transitioned from having one of Europe’s most restrictive policies to one of its most accessible.
This pathway is specifically designed for the descendants of former Czechoslovak citizens who were born in the territory of the modern-day Slovak Republic. Unlike standard naturalization, this process does not require you to live in Slovakia for years or pass a Slovak language proficiency exam. It is often confused with the Slovak Living Abroad (SLA) certificate; however, while the SLA certificate is a residency tool for ethnic Slovaks, CBD provides a direct path to a passport and full nationality.
The "Residency" Formality
A unique aspect of the Slovak CBD process is that it technically requires a "permanent residency" component. However, for descendants, this is largely a legal formality. You apply for permanent residence for "reasons of special consideration" simultaneously with your citizenship application. While the law mentions residency, you are not required to physically relocate to Slovakia or maintain a home there during the processing period.
Rights as a Slovak Citizen
Once you receive your Certificate of Slovak Citizenship and take the citizenship oath, you are granted the same rights as any other Slovak national:
- EU Freedom of Movement: You gain the right to live, work, and study indefinitely in any of the 27 European Union member states, as well as Switzerland, Norway, Iceland, and Liechtenstein.
- Slovak Passport: You are eligible for a Slovak passport, consistently ranked as one of the most powerful travel documents in the world for visa-free travel.
- Consular Protection: You are entitled to protection and assistance from Slovak and EU embassies when traveling abroad.
- Voting Rights: You gain the right to vote in Slovak national elections and European Parliament elections.
- Access to Services: You have full access to the Slovak healthcare and education systems under the same conditions as local citizens.
- Family Reunification: You can pass Slovak citizenship down to your children, and your spouse becomes eligible for simplified residency pathways within the EU.
