Requirements
To qualify for protection in Portugal, you must meet the criteria for one of the two following categories:
1. Refugee Status
You must demonstrate a well-founded fear of persecution in your country of nationality (or habitual residence if you are stateless) based on at least one of these five grounds:
- Race or Religion
- Nationality
- Political Opinion
- Membership in a particular social group (this often includes gender-based persecution or sexual orientation)
2. Subsidiary Protection
If you do not qualify as a refugee, you may still be granted protection if there are substantial grounds to believe you face a real risk of serious harm upon return, defined as:
- The death penalty or execution.
- Torture, inhuman, or degrading treatment.
- A serious and individual threat to your life due to indiscriminate violence in situations of international or internal armed conflict.
Key Limitations and Disqualifiers
- Safe Country of Origin: As of February 2026, Portugal follows a common EU list of "safe countries" (including India, Morocco, Tunisia, Bangladesh, Colombia, Egypt, and Kosovo). If you are from one of these countries, your application faces accelerated processing and you carry a much higher burden of proof to show why the country is not safe for you specifically.
- Safe Third Country: Your application may be rejected if you traveled through a "safe third country" where you could have reasonably requested protection before arriving in Portugal.
- Dublin Regulation: If another EU country is determined to be responsible for your asylum claim (usually the first EU country you entered), Portugal may transfer you to that country.
- Subsequent Applications: If you apply for asylum a second time after a previous rejection, you must provide new facts or evidence within five working days, or the claim will be summarily rejected.
Conditions & Warnings
Strict 5-day deadlines apply for appeals and subsequent applications; missing these can lead to immediate deportation orders.
Nationals from EU-designated 'safe countries' (e.g., India, Morocco, Tunisia) face accelerated processing and a significantly higher burden of proof.
Failure to update your physical address with AIMA is a common cause for application rejection and case archiving.
