Overview
Portuguese citizenship through marriage or a de facto union is a pathway for the partners of Portuguese citizens to acquire nationality by "declaration of will." Unlike standard naturalization, this process does not strictly require you to live in Portugal, making it a popular option for the global Portuguese diaspora and their families.
While the pathway is accessible, it is not automatic. You must prove the legitimacy and duration of your relationship, and in many cases, demonstrate "effective ties" to the Portuguese community. If your marriage took place outside of Portugal, you must first complete a transcrição de casamento (marriage transcription) to register the union in the Portuguese civil registry before you can begin this process.
Important Limitations
- Marital Status: Your marriage or union must be active and intact throughout the entire application process. If you divorce or separate before the final registration of your citizenship, you lose the right to acquire nationality through this pathway.
- Processing Backlogs: Due to a massive surge in applications, the current reality for processing is significantly longer than official estimates. As of 2026, applicants should expect a wait of 36 to 48 months from the date of submission to final registration.
- The 6-Year Strategy: If you do not live in Portugal, do not speak the language, and do not have Portuguese children, legal experts often recommend waiting until you have reached six years of marriage before applying. At this milestone, the Public Prosecutor can no longer oppose your application based on a "lack of ties," significantly increasing your chances of success.
Rights as a Portuguese Citizen
Once your nationality is registered, you hold the same rights as any other Portuguese citizen.
- EU Freedom of Movement: You gain the right to live, work, and study in any of the 27 European Union member states without a visa.
- Consular Protection: You are entitled to protection and assistance from Portuguese and EU embassies and consulates worldwide.
- Voting Rights: You have the right to vote in Portuguese national elections and European Parliament elections.
- Passports and Travel: You are eligible for a Portuguese Passport and a Cartão de Cidadão (Citizen Card), providing visa-free access to over 180 countries.
- Public Services: You gain full access to the Portuguese national healthcare system (SNS) and public education at the same rates as local residents.
