- Nationality: You must be a citizen of the People's Republic of China holding a valid PRC passport.
- Marital Status: You must be legally married to a Filipino citizen. The marriage must be valid under Philippine law and officially recorded.
- Dependents: You may include your legitimate, natural-born, or legally adopted unmarried children under the age of 21 in your application.
- Financial Capacity: You must demonstrate that you have the financial means to support yourself and your family in the Philippines without becoming a public charge.
- Health and Character: You must be free from dangerous or contagious diseases and have no "derogatory record" (criminal history) with the Philippine Bureau of Immigration or the National Bureau of Investigation (NBI).
Important Limitations:
- Sham Marriages: If the Bureau of Immigration (BI) determines the marriage was entered into solely for immigration benefits, the visa will be denied or revoked.
- Legal Validity: If your marriage is annulled or declared void, your residency status under this category will be terminated.

The initial visa is only probationary for one year; you must apply for amendment to permanent status at least 60 days before it expires.

You must maintain a valid temporary stay (e.g., tourist visa) while the permanent resident application is pending.
