Requirements
To qualify for this visa, the applicant must meet specific criteria regarding their birth timing, their parent's legal status, and their own civil status.
- Birth Timing: The child must have been born after the issuance of a 13-series immigrant visa to the accompanying parent. If the child was born before the parent received their visa, they do not qualify for 13(C) and must be included in the parent's initial application or apply under a different category.
- Parental Status: At least one parent must hold a valid 13-series visa. Common qualifying visas include:
- 13(A): For spouses of Philippine citizens.
- 13(G): For former natural-born Philippine citizens.
- Quota Visa (13): For those granted residency under the annual quota system.
- Age and Civil Status: The applicant must be under 21 years of age and must be unmarried. If the child marries or turns 21 before the visa is granted, they lose eligibility for this specific pathway.
- Location of Birth: The birth must have occurred within the geographical boundaries of the Philippines.
