Overview
International protection in Hungary is a legal status granted to individuals fleeing persecution or serious harm in their home countries. It is divided into two primary categories: Refugee Status (Menekült) and Subsidiary Protection (Oltalmazott).
Since 2020, Hungary has operated under a "state of crisis due to mass migration," which has fundamentally altered how you can access this pathway. Unlike most countries where you apply at the border or within the territory, Hungary currently requires most applicants to undergo a mandatory Embassy Procedure (submitting a "Statement of Intent") at a designated Hungarian embassy abroad before they are even permitted to enter the country to file an official application.
Important Limitations
- State of Crisis: The "state of crisis due to mass migration" has been extended through 2026. This means the restrictive embassy procedure remains the only legal way for most people to seek protection.
- Lack of State Support: Since 2016, Hungary has abolished almost all state-funded integration support. There are no state-provided housing subsidies or free language classes once you are granted protection. You will likely rely on NGOs like the Hungarian Helsinki Committee for support.
- Mandatory Reviews: Your status is not permanent. Hungary conducts a mandatory review of your protection status every 3 years. If the authorities decide the situation in your home country has improved, your status can be revoked.
Rights as a Protected Person
Once you are recognized as a Refugee or a Beneficiary of Subsidiary Protection, you are issued a Residence Permit (usually valid for 3 years and renewable).
- Right to Work: You have full access to the Hungarian labor market. You do not need a separate work permit to be employed.
- Right to Travel: Refugees receive a Convention Travel Document (Blue Passport). Subsidiary beneficiaries receive a "Travel Document for Stateless Persons" if they are unable to obtain a passport from their home country.
- Family Reunification: Refugees have a strong right to bring their spouse and minor children to Hungary. If you apply within 3 months of receiving your status, you do not have to prove you have a specific income or housing. Subsidiary beneficiaries have much more restricted rights to family reunification.
- Access to Services: You are entitled to the same emergency healthcare and public education as Hungarian citizens, though navigating these systems without state-funded integration assistance can be challenging.
- Path to Citizenship: You may apply for Hungarian citizenship after 8 years of continuous residence, provided you meet language and integration requirements.
