Overview
The Residence Card for Family Members of a Union Citizen is a pathway designed for non-EU/EEA/Swiss nationals who wish to live in Greece with a family member who is a citizen of an EU/EEA country or Switzerland. This permit is governed by the Greek Immigration Code (Law 5038/2023) and is based on the principle of free movement within the European Union.
It is important to distinguish this from "Family Reunification" for non-EU sponsors. This specific pathway is significantly more streamlined, carries no government application fees, and offers broader rights because it is tied to the rights of an EU citizen exercising their freedom of movement.
Validity and Permanent Residency
- Initial Validity: The Residence Card is typically issued for five (5) years. If the EU citizen intends to stay for a shorter period, the card may be issued to match that duration.
- Permanent Residence: After five years of continuous legal residence in Greece, you become eligible for a Permanent Residence Card. This card is valid for ten years and is renewed automatically upon request.
- Retention of Rights: In specific cases, such as the death of the EU citizen or divorce (if the marriage lasted at least three years), you may be able to retain your right of residence independently.
Rights as a Family Member of an EU Citizen
Holding this residence card grants you a high degree of integration into Greek society, nearly equivalent to the rights of the EU citizen themselves.
- Full Work Rights: You have the right to work as an employee or start a business (self-employment) in Greece without needing any additional work authorization.
- Schengen Travel: You may travel to other countries within the Schengen Area for up to 90 days in any 180-day period using your passport and residence card.
- Access to Services: You are entitled to the same access to public education, vocational training, and social healthcare as Greek citizens.
- Path to Citizenship: Time spent living in Greece under this permit counts toward the residency requirements for Greek naturalization, provided other criteria (such as language proficiency) are met.
- Immediate Legal Status: Upon submitting your application, you receive a "Blue Receipt" (Beveosi), which allows you to stay and work in Greece legally while your card is being printed.
