Overview
The Residence Permit (Dependant) is a legal authorization issued by the Ghana Immigration Service (GIS) that allows the family members of expatriates or Ghanaian nationals with foreign passports to live in Ghana. This pathway is designed to keep families together while the principal member—the person you are "dependent" on—works or resides in the country.
It is important to distinguish this from a Work Permit. This permit is strictly for residency only; it does not grant you the right to seek employment or operate a business in Ghana. If you intend to work, you must apply for a separate work authorization.
Important Limitations
The Ghana Immigration Service enforces strict rules regarding the status of dependants. You should be aware of the following:
- Annual Renewal: These permits are typically issued for one year. You must apply for a renewal at least 30 days before your current permit expires.
- Overstay Penalties: Staying in Ghana with an expired permit is a serious offense. Penalties are approximately GHS 300 per month for standard residents.
- The "Ghana Card" Prerequisite: You cannot bypass the Non-Citizen ID card requirement. This registration must be completed at an NIA office or designated bank before the GIS will process your residency application.
Rights as a Dependant
Holding a Dependant Residence Permit grants you specific legal protections and benefits while in Ghana:
- Legal Residency: You have the right to live in Ghana for the duration of your permit (usually 12 months, renewable).
- Travel and Re-entry: You may leave and re-enter Ghana, provided you obtain a re-entry permit or hold a multiple-entry endorsement.
- Path to Indefinite Residence: Time spent in Ghana on a dependant permit counts toward the 5 years of continuous residence required to apply for Indefinite Residence.
- Path to Citizenship: If you are the spouse of a Ghanaian citizen, your time on this permit contributes toward the requirements for Citizenship by Registration.
- Education: Dependants are generally permitted to enroll in educational institutions (schools/universities) without needing a separate student permit, though the institution may require proof of your valid residency.
- No Right to Work: Crucially, you do not have the right to work. Engaging in any form of paid employment or business activity without a separate Work Permit is a violation of your status and can lead to deportation.
