The Mercosur Temporary Residence (Residencia Temporaria por Acuerdo Mercosur) is a streamlined immigration pathway designed to facilitate the free movement of people within South America. Unlike traditional work or investment visas, this residency is granted based almost entirely on your nationality. It is intended for citizens of Mercosur member and associate states who wish to live, work, or study in Argentina without the burden of proving high income, specialized skills, or employer sponsorship.
This pathway is governed by the Mercosur Residence Agreement, which Argentina ratified to simplify the legal stay of regional neighbors. It is widely considered one of the most accessible residency programs in the world for those who qualify by birth or naturalization.
Important Limitations and Variations
While the process is standardized, there are a few critical nuances to keep in mind:
- The Brazil Exception: Due to a specific bilateral agreement, native-born Brazilians may be eligible to skip the temporary stage and apply directly for Permanent Residency, provided they meet the documentation requirements.
- Document Expiration: Criminal record certificates are generally only considered valid for 90 days from the date of issuance. You must ensure they are "fresh" when you begin your application.
- The "Precaria" Status: After submitting your application, you receive a Residencia Precaria. This is a legal bridge document. While it grants you the right to stay and work, some private institutions (like banks) may be hesitant to accept it until you receive your physical DNI (Documento Nacional de Identidad).
Rights as a Mercosur Temporary Resident
Once your residency is approved, you are issued an Argentine DNI with a "Foreigner" designation. This grants you a robust set of rights nearly identical to those of Argentine citizens.
- Work Rights: You have the full right to work as an employee, start a business, or work as a freelancer (Monotributista) without needing a separate work permit.
- Two-Year Duration: This status is valid for two years.
- Path to Permanent Residency: After holding this temporary status for two years, you are eligible to apply for Permanent Residency. This is a faster track than the three years required for non-Mercosur nationals.
- Path to Citizenship: Under the Argentine Constitution, you can apply for Naturalization (Citizenship) after two years of continuous residence in the country.
- Family Reunification: You have the right to bring your spouse, children, or parents to Argentina under the family reunification category.
- Access to Services: You gain full access to public healthcare and the public education system.
- Travel Rights: You may enter and exit Argentina freely. As a resident, you can often travel to other Mercosur countries using only your Argentine DNI.
