Overview
Indian citizenship by descent is a pathway for individuals born outside of India to acquire Indian nationality based on their parental lineage. Governed by Section 4 of the Citizenship Act, 1955, this pathway ensures that the children of Indian citizens maintain a legal connection to India, regardless of their place of birth.
It is important to distinguish this from Citizenship by Birth (Section 3), which applies primarily to those born within Indian territory. Citizenship by descent is specifically for the Indian diaspora born abroad. Because Indian law has evolved significantly, your eligibility depends entirely on your date of birth.
Limitations and Dual Nationality
The most critical limitation of Indian citizenship is the prohibition of dual nationality. Under the Citizenship Act, if you voluntarily acquire the citizenship of another country, your Indian citizenship ceases immediately.
If you are a minor who acquired another citizenship by birth (e.g., born in the US to Indian parents), you may hold that foreign citizenship until the age of 18. However, to retain Indian citizenship, you must renounce the foreign nationality within six months of reaching the age of 18.
Rights as an Indian Citizen
Acquiring citizenship by descent grants you the same legal standing as any person born within India.
- Right to Abode: You have the absolute right to live, work, and reside anywhere in India without a visa or residence permit.
- Political Rights: You have the right to vote in local, state, and national elections and the right to hold public office, including the Presidency or a seat in Parliament.
- Consular Protection: You are entitled to the protection and assistance of the Indian government when traveling or residing abroad.
- Property Ownership: You can own agricultural land and plantations, a right generally restricted for non-citizens (including OCI cardholders).
- Access to Services: Full access to government schemes, subsidies, and domestic-rate fees for educational institutions and national parks.
- Passport Eligibility: You are entitled to hold an Indian Passport, which serves as definitive proof of your nationality and status.
