Requirements
To qualify under Article 16, you must demonstrate a consistent and long-standing affiliation with the Croatian ethnic identity. Eligibility is based on "belonging" rather than a simple paper trail of residency.
- Ethnic Identification: You must show that you have publicly and officially declared yourself as an ethnic Croat in legal transactions or official documents throughout your life.
- Exemption from Integration Tests: You are not required to prove proficiency in the Croatian language, the Latin script, or knowledge of Croatian social systems.
- Respect for Legal Order: You must demonstrate that you respect the customs and legal order of the Republic of Croatia and that your admission does not pose a threat to national security.
- Consistent Declaration: A key threshold is the absence of conflicting ethnic declarations. If you have previously registered yourself as another ethnicity (e.g., Yugoslav or Serbian) in official records, your application may be rejected unless you can prove that declaration was coerced or changed long ago.
- Ancestral "Belonging": If you have not personally declared your ethnicity in the past, you can qualify by proving the Croatian ethnicity of your parents or grandparents. While the law allows for ancestral proof, cases involving great-grandparents are subject to much higher scrutiny.
Conditions & Warnings
Applicants who previously declared as 'Yugoslav' in official records may face rejection unless they can prove the declaration was coerced.
While the law is broad, current practice heavily scrutinizes claims going back further than grandparents.
Significant backlogs exist due to high application volumes from South America and Bosnia and Herzegovina.
Qualifications
Exempt from Croatian language, Latin script, and culture exams as of January 1, 2020.
Fees
Includes approximately €250 consular fee and €140 final decision fee. Excludes translation and apostille costs.
