Overview
Article 11 of the Zakon o hrvatskom državljanstvu (Croatian Citizenship Act) is a specialized legal pathway designed for Croatian emigrants and their descendants to reclaim their ancestral citizenship. It is often referred to as the "diaspora" pathway because it focuses on those whose families left the territory of modern-day Croatia to settle permanently abroad.
This pathway is distinct from other forms of citizenship by descent. Unlike Article 5, which is for children of current citizens, Article 11 is specifically for those whose ancestors may have lost or given up their citizenship upon leaving. Crucially, as of January 1, 2020, this pathway no longer requires applicants to pass a Croatian language or culture test, making it one of the most accessible "Right of Return" laws in Europe.
Important Limitations
While Article 11 is broad, it has strict boundaries regarding the former Yugoslavia. If your ancestor identified as "Yugoslavian" and emigrated from a region that is now part of Serbia, Bosnia, or another former republic, you will likely be ineligible for this specific pathway. The law is strictly tied to the territory of the modern Republic of Croatia.
Furthermore, the October 8, 1991 date is a hard deadline. If your parents or grandparents left during or after the Homeland War (1991–1995), you cannot apply under Article 11. You would instead need to investigate Article 5 (if they maintained citizenship) or Article 16 (if you can prove Croatian ethnicity through active participation in diaspora organizations).
Rights as a Croatian Citizen
Once your application is approved and you receive your Domovnica (Certificate of Citizenship), you hold the same rights as any person born in Zagreb.
- EU Freedom of Movement: As a citizen of an EU member state, you have the right to live, work, and study in any of the 27 European Union countries without a visa or work permit.
- Dual Citizenship: Croatia explicitly allows dual citizenship for those applying under Article 11. You are not required to renounce your current nationality.
- Consular Protection: You are entitled to protection from Croatian and EU embassies while traveling abroad.
- Voting Rights: You gain the right to vote in Croatian national and European Parliament elections.
- Property Ownership: You can purchase and inherit real estate in Croatia under the same conditions as local residents, bypassing the reciprocity requirements faced by foreigners.
- Family Reunification: You can sponsor non-EU family members for residency in Croatia or other EU countries under simplified "Union Citizen" rules.
