Overview
Argentine citizenship by descent, legally known as Nationality by Option (Nacionalidad por Opción), is a constitutional right that allows the children of native-born Argentines to claim citizenship regardless of where they were born. Unlike many European "jus sanguinis" pathways that allow claims through distant ancestors, the Argentine pathway is strictly limited to the first generation (direct children).
This pathway is governed by Law No. 346 and Decree 3213/84. It is important to distinguish this from "Naturalization." While naturalization is a discretionary grant for residents, Nationality by Option is an inherent right that, once exercised, grants you the status of a national. Because Argentina considers this nationality "irrenunciable" (non-renounceable), once you obtain it, you generally hold it for life.
Legal Framework and Context
The Argentine Constitution and Law 346 are rooted in a "pro-immigration" philosophy. The preamble of the Constitution explicitly welcomes "all men of the world who wish to inhabit Argentine soil." Because of this, the process is administrative rather than judicial for most direct children.
However, it is vital to understand the Irrenunciability of Argentine nationality. Argentina generally does not allow its citizens to renounce their nationality. If you "opt" for Argentine citizenship, you are an Argentine for life in the eyes of the Argentine state, even if you attempt to renounce it at a later date. This rarely affects dual nationality, as Argentina permits its citizens to hold multiple passports.
Rights as an Argentine Citizen
Once you have completed the "Act of Option" and received your DNI, you hold nearly all the same rights as a citizen born in Buenos Aires.
- Right to Abode: You have the permanent right to live, work, and study in Argentina without a visa or residency permit.
- MERCOSUR Freedom of Movement: As an Argentine citizen, you benefit from the MERCOSUR Residency Agreement, which simplifies the process of obtaining legal residency and work authorization in member and associate states, including Brazil, Uruguay, Paraguay, and Chile.
- Consular Protection: You are entitled to protection and assistance from Argentine embassies and consulates worldwide.
- Voting Rights: You have the right to vote in national elections, though for those living abroad, registration in the Registro de Electores Residentes en el Exterior is required.
- Visa-Free Travel: You gain access to the Argentine passport, which provides visa-free or visa-on-arrival access to over 170 countries, including the Schengen Area, Russia, and most of South America.
- Access to Public Services: Full access to Argentina’s public healthcare and education systems (including renowned public universities).
